These Terms and Conditions apply to all transactions, enquiries, orders, purchases, sales, refining services, bullion dealings, storage arrangements, pool allocated bullion arrangements and related services provided by AussieMint, unless otherwise agreed in writing.

By placing an order, requesting a quote, selling precious metals to us, purchasing bullion from us, using our website, visiting our premises, or engaging our services, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions:

AussieMint, we, us or our means ARORA PRECIOUS METAL REFINERY PTY LTD trading as AussieMint.

Customer, you or your means any person, business, company, organisation, representative, agent or entity that deals with AussieMint.

Bullion means gold, silver, platinum, palladium or other precious metal products, including bars, coins, granules, refined metal, cast products, minted products and other precious metal items offered for sale, purchase, storage or processing by AussieMint.

Precious metals means gold, silver, platinum, palladium and any other valuable metal or material accepted by AussieMint.

Order means any request to buy, sell, refine, process, assay, store, collect or deliver bullion or precious metals.

Spot price means the prevailing market price of the relevant precious metal at the relevant time, as determined by AussieMint using market data, supplier pricing, refinery pricing, exchange rates and other applicable costs.

Pool allocated bullion means bullion purchased or held by a customer where the customer has an entitlement to a specified quantity and type of metal, but not necessarily to specific individually numbered bars or coins unless expressly agreed in writing.

2. General Terms of Trade

All orders and transactions are subject to acceptance by AussieMint. We reserve the right to refuse, cancel, amend or decline any order or service request at our discretion, including where there is a pricing error, stock issue, compliance concern, suspected fraud, identity verification issue, payment delay, market volatility, operational issue or other reasonable business reason.

AussieMint sells gold and silver bullion through its website and in store. AussieMint also buys back gold and silver, subject to inspection, verification, compliance checks and acceptance by us.

Prices, quotes, rates and product availability may change without notice. Precious metal prices are highly volatile and may move quickly due to market conditions, exchange rates, supplier availability, refining conditions and global trading activity.

A quote is not a binding agreement unless we confirm the transaction in writing or otherwise accept the order. Where prices are time-sensitive, you must complete payment or acceptance within the stated timeframe.

3. Buying Bullion from AussieMint

When you purchase bullion from AussieMint online or in store, you agree to pay the quoted or confirmed purchase price, plus any applicable fees, premiums, GST, shipping, insurance, handling, storage or other charges advised at the time of purchase.

Orders must be paid for immediately unless we agree otherwise in writing. If payment is not received within the required timeframe, we may cancel, amend or re-price the order.

Where required, you must provide payment confirmation, remittance advice, identification documents or other information requested by AussieMint before the order is processed, released, shipped, allocated, stored or made available for collection.

All bullion orders are final once accepted by AussieMint. Please check all product details, metal type, weight, quantity, delivery method and payment details carefully before confirming your purchase.

4. Selling Gold and Silver to AussieMint

When selling gold, silver or other precious metals to AussieMint, you warrant that:

  1. you are the lawful owner of the goods;
  2. the goods are not stolen, encumbered, subject to a security interest or owned by another party;
  3. you have full authority to sell the goods;
  4. all information provided by you is true, accurate and complete;
  5. you will provide valid identification and any supporting documents requested by AussieMint.

AussieMint may test, weigh, assay, inspect or verify precious metals before confirming a purchase price. Any initial estimate given before testing or verification is indicative only and may change after assessment.

Buyback prices are based on the applicable market rate, metal type, purity, weight, condition, demand, refinery assessment and other relevant factors at the time the transaction is accepted by AussieMint.

We reserve the right to refuse to purchase any item or material at our discretion.

5. Refining, Assay and Processing Services

Where AussieMint provides refining, assay or processing services, the final result may depend on the quality, composition, weight, contamination level, moisture level, impurities, sampling method and metal content of the material supplied.

Any estimate of metal yield, value, purity, recovery, processing time or final payment is indicative only unless expressly confirmed in writing.

You acknowledge that refining and assay services may involve melting, testing, sampling, chemical processing or other irreversible processes. Once material has been submitted and processing has commenced, the original item or material may not be recoverable in its original form.

AussieMint is not responsible for differences between expected and actual recovery, purity, assay outcome or value where those differences arise from the actual composition or quality of the material supplied.

6. Pricing, Market Volatility and Order Amendments

Precious metal prices can move rapidly. If there is a significant movement in market price, supplier price, currency exchange rate, premium, freight cost, insurance cost or other applicable cost between the time of your enquiry and the time your order is accepted, AussieMint may amend the price or request additional payment.

If an order is affected by a pricing error, system error, typographical error, market data error, supplier error or website error, AussieMint may cancel, correct or re-price the order.

If additional payment is required, you must pay the balance within the timeframe advised by AussieMint. If you do not do so, we may cancel the order and apply any applicable cancellation, administration or loss recovery fees.

7. Payment Terms

Payment must be made by an accepted payment method advised by AussieMint. Orders will not be released, shipped, allocated, stored or completed until cleared funds have been received unless we agree otherwise in writing.

You are responsible for ensuring that your bank transfer, deposit, payment limit or payment method is suitable for the order amount. Bank delays, daily transfer limits or payment restrictions do not automatically cancel an order or remove your obligation to pay.

Where payment is late, incomplete, reversed, dishonoured or not received, AussieMint may:

  1. cancel or amend the order;
  2. charge an administration fee;
  3. recover any market loss caused by non-payment;
  4. recover debt collection costs, legal costs and other reasonable expenses;
  5. refuse future orders or services.

8. Cancellations, Amendments and Refunds

All accepted bullion orders are final. Due to the live and volatile nature of precious metal pricing, change-of-mind cancellations are not accepted once an order has been confirmed.

If you request cancellation after an order has been accepted, AussieMint may, at its discretion, agree to cancel the order subject to a cancellation fee equal to 1% of the order value or $55, whichever is greater, plus any market loss, supplier cost, administration cost, handling fee, payment processing cost, storage cost or other expense incurred by AussieMint.

If you have already paid for bullion and wish to exit the transaction, AussieMint may offer to buy the bullion back from you at our applicable buyback rate at that time. The buyback price may be lower than your original purchase price.

Refunds, where approved, will be processed to the original payment method or another method approved by AussieMint. Processing times may vary depending on banks and payment providers.

Nothing in these Terms and Conditions excludes rights you may have under the Australian Consumer Law.

9. Pre-Orders and Backorders

Some bullion or precious metal products may be sold as pre-order, backorder or subject to supplier availability.

By placing a pre-order or backorder, you acknowledge that the item is not currently available for immediate collection or dispatch. Any estimated arrival date is an estimate only and is not guaranteed.

AussieMint is not liable for delays caused by suppliers, transport providers, refiners, mints, market demand, customs, regulatory requirements, stock shortages or other circumstances outside our reasonable control.

If a pre-order or backorder cannot be fulfilled within a reasonable timeframe, AussieMint may offer a replacement product, revised delivery timeframe, store credit or refund.

10. Collection of Orders

If you choose to collect an order from our premises, you must provide valid identification and any order confirmation requested by AussieMint.

Orders must be collected within the timeframe advised by AussieMint. If an order is not collected within that timeframe, storage or administration fees may apply.

AussieMint may refuse to release goods where identification is incomplete, payment has not cleared, compliance checks are outstanding, or we reasonably believe the person collecting the goods is not authorised.

Risk in the goods passes to you when the goods are collected by you or your authorised representative.

11. Shipping and Delivery

AussieMint ships orders within Australia only. We do not accept international orders unless expressly agreed in writing.

All shipped bullion orders must be sent with insurance. Insurance is mandatory for delivery orders and the applicable insurance cost will be added to the order total.

Where AussieMint agrees to arrange delivery, we may use Australia Post, courier, secure transport or another delivery provider selected by us.

Shipping, insurance, packaging and handling fees may apply. Delivery timeframes are estimates only and are not guaranteed.

You must provide accurate Australian delivery details. AussieMint is not responsible for loss, delay or additional cost caused by incorrect, incomplete or outdated delivery information supplied by you.

You may be required to sign for delivery, provide identification or be available at the nominated address. If delivery fails because no authorised person is available, additional delivery, insurance or handling fees may apply.

Any delivery issue must be reported to AussieMint and the delivery provider as soon as possible. You must cooperate with any investigation, including providing declarations, police reports, identity documents or other supporting information where required.

12. Australia-Only Orders

AussieMint accepts orders from customers located in Australia only.

We do not offer international shipping through our standard website ordering process. Orders requiring delivery outside Australia may be refused, cancelled or refunded at our discretion.

Customers are responsible for ensuring that they provide a valid Australian delivery address or arrange approved in-store collection.

13. Storage Services

Where AussieMint agrees to hold bullion or precious metals on your behalf, storage terms, fees, insurance arrangements, identification requirements and release conditions will be confirmed separately or through your customer account.

AussieMint may charge storage fees for goods that remain uncollected after the agreed collection period or for bullion held under an agreed storage arrangement.

Goods will not be released until all outstanding amounts, including storage, refining, assay, handling, delivery, administration or other applicable fees, have been paid.

AussieMint may require reasonable notice before releasing stored bullion or precious metals.

14. Pool Allocated Bullion

AussieMint may offer pool allocated bullion arrangements, subject to availability, account approval and our internal procedures.

Under a pool allocated arrangement, you hold an entitlement to a specified quantity and type of metal. Unless expressly agreed in writing, you may not have ownership of a specific individual bar, coin or serial-numbered item.

Pool allocated bullion may be converted, sold, transferred, withdrawn or delivered only in accordance with AussieMint’s applicable procedures, fees, minimum quantities, availability and compliance requirements.

Where physical withdrawal or delivery is requested, fabrication fees, conversion fees, storage fees, handling fees, shipping fees, mandatory insurance fees or other costs may apply.

AussieMint may refuse or delay withdrawal, transfer, sale or delivery of pool allocated bullion where identification checks, payment checks, compliance checks, account checks or operational requirements have not been completed.

15. Identification, Compliance and AUSTRAC Obligations

AussieMint may be required to collect, verify and retain customer identification and transaction information to comply with Australian laws, including anti-money laundering and counter-terrorism financing obligations where applicable.

You agree to provide all identification documents, business records, source of funds information, ownership information, authority documents or other details reasonably requested by AussieMint.

We may refuse, delay, cancel or report a transaction where we are required or permitted to do so by law, regulation, compliance policy or risk assessment.

AussieMint is not liable for any loss, delay or inconvenience caused by compliance checks, identity verification, reporting obligations or legal requirements.

16. Customer Warranties

You warrant that:

  1. you are at least 18 years old;
  2. you have legal capacity to enter into the transaction;
  3. all information you provide is accurate and complete;
  4. you are not using AussieMint’s services for unlawful purposes;
  5. funds used for purchases are lawfully obtained;
  6. precious metals or goods supplied by you are lawfully owned by you;
  7. you will comply with all applicable laws and regulations.

17. Website Information

Information on the AussieMint website is provided for general information only. While we aim to keep information accurate and current, we do not guarantee that all pricing, availability, product descriptions, images, market commentary or service details are complete, current or error-free.

Website pricing may change without notice. Product images are for illustration only and may differ from the actual item supplied.

We reserve the right to correct errors, update content, change pricing, modify services or remove products at any time.

18. Limitation of Liability

To the maximum extent permitted by law, AussieMint is not liable for indirect loss, consequential loss, loss of profit, loss of opportunity, market loss, investment loss, loss caused by price movement, loss caused by delay, or loss arising from events outside our reasonable control.

Where our liability cannot be excluded, our liability is limited, where permitted by law, to one or more of the following:

  1. replacement of goods;
  2. repair of goods;
  3. resupply of services;
  4. payment of the cost of replacing goods or resupplying services;
  5. refund of the amount paid for the affected goods or services.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian law.

19. Investment Disclaimer

AussieMint does not provide financial, investment, taxation or legal advice. Any information provided about bullion, precious metals, pricing, market trends or investment considerations is general information only.

You should obtain independent financial, taxation and legal advice before buying, selling, storing or holding bullion or precious metals.

Precious metal prices can rise and fall. Past performance is not a reliable indicator of future performance. You are responsible for your own buying and selling decisions.

20. Privacy

By dealing with AussieMint, you consent to us collecting, using and storing your personal information for the purpose of providing services, processing transactions, verifying identity, meeting legal obligations, communicating with you and managing our business operations.

Personal information may be disclosed where required by law, to payment providers, delivery providers, insurance providers, storage providers, compliance service providers, professional advisers, regulators, law enforcement agencies or other parties where reasonably necessary.

21. Force Majeure

AussieMint is not liable for delay or failure to perform any obligation where the delay or failure is caused by circumstances beyond our reasonable control, including market disruption, supplier delay, transport delay, natural disaster, pandemic, government action, regulatory change, system outage, cyber incident, labour shortage, war, terrorism, civil unrest, power failure or other unexpected event.

22. Debt Recovery and Enforcement

If you fail to pay an amount owed to AussieMint, we may recover the outstanding amount together with any reasonable administration fees, debt collection costs, legal costs, market losses and other expenses incurred in enforcing our rights.

You agree to indemnify AussieMint for losses, costs or expenses arising from false information, non-payment, unauthorised transactions, unlawful ownership claims, breach of these Terms and Conditions or breach of law.

23. Changes to These Terms

AussieMint may update these Terms and Conditions at any time by publishing a revised version on our website or otherwise making them available to customers.

The version that applies to your transaction is the version in effect at the time your order or service request is accepted, unless otherwise required by law.

24. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
